Killer did not have a devil fruit previously. When queen said they both have devil fruits, he is referring to killer eating a smile fruit (which is technically a devil fruit just artificial) and kid with his normal devil fruit! As the smile fruits (whether success at providing the consumer a ability or not) will still suffer the consequence of not being able to swim!
