Yes but Penny saves her from a fatal fall caused by Cinder, so ... Yes Winter is injured, but without Penny she was simply dead. What the spec ops say is just to hurt Penny and manipulate her, like Ironwood does in episode 1.

Penny "stealing" the power is pretty misinformed. But I think accusing Penny of being responsible for Winter's condition isn't so off-base. Remember; Penny's specific job and purpose for accompanying Winter to the maiden last volume was to protect Winter and keep her safe. Penny failed to do that.
