It wasn't murder, the guy committed suicide by overdosing. It was his choice to buy drugs with the money. Tony gave him the means to choose for himself, calling him a murderer is like blaming the guy who sold Kurt Cobain a shotgun.

That moment where he gives him the money hits pretty hard. In that moment they both see it as an act of kindness or mercy. It's a strange ethical thing... What is more cruel, to give him the money to end his own suffering, or to say he has to carry on suffering for the sake of those who care for him? If someone in the pits of despair wants to end their own suffering, is it not selfish to say to them "how do you think -I- would feel if you did that?". A lot of people see something like this as a morally black & white dilemma when they don't understand what grief & such agonizing depression is like, but there's so much grey in between that usually gets dismissed or overlooked.
